MODIFICATION OF THIS AGREEMENTĭave reserves the right to amend this Agreement at any time and will notify you of any such changes by posting the revised Agreement on its website,. To use Mobile App, or the Services and to accept the Agreement, you must be 1) a legal resident of the United States, 2) of legal age to form a binding contract with Dave, 3) not prohibited by law from using the Mobile App, or the Services. If you do not agree to these terms, you may not access or use the Mobile App, or the Services. THIS AGREEMENT ALSO INCLUDES, AMONG OTHER THINGS, A BINDING ARBITRATION PROVISION THAT CONTAINS A CLASS ACTION WAIVER. The terms and conditions of this Agreement form an essential basis of the bargain between you and Dave, and this Agreement governs your use of the Mobile App, and the Services. By accessing, browsing and/or using the Mobile App, or the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement and to comply with all applicable laws and regulations. The Mobile App, website and Services are owned and operated by Dave, and are being provided to you expressly subject to this Agreement. The following terms of service are terms of a legal agreement (the “Agreement”) between you (“you”, “your”, or “user”) and Dave Inc., its subsidiaries, affiliates, agents and assigns (“Dave”, “we”, “us”, or “our”) which sets forth the terms and conditions for your use of Dave’s mobile application (“Mobile App”) and Dave’s website,, as well as the products and services offered, operated or made available by Dave through the Mobile App (collectively, the “Services”).
